TERMS & CONDITIONS

In partial consideration for being allowed to visit Steinbeck House and the property on which it is located, in Suffolk County, New York (hereinafter described as the “Premises”) I agree to abide by all rules, regulations or instructions which I am provided by the owners, lessee, and/or  docents of Steinbeck House and/or their agents, representatives, and employees (hereinafter collectively described as “Owners and Operators”).

I further ACKNOWLEDGE AND UNDERSTAND THAT NO WARRANTY, EITHER EXPRESS OR IMPLIED, IS MADE by the Owners and Operators of the Premises, as to the condition of any roads, buildings, gates, or other improvements on the Premises, or the Premises itself, THAT DANGEROUS CONDITIONS POSSIBLY EXIST and THAT THIS DOCUMENT IS SUFFICIENT WARNING that there are numerous possible dangerous conditions, risks and hazards involved in (the activity) on the Premises and in use of the improvements situated thereon, and that the activities that I desire to undertake and my presence on the leased premises expose me and my property to possible dangerous conditions, risks and hazards.  I further hereby state that I EXPRESSLY ASSUME ALL SUCH RISKS, HAZARDS AND DANGERS with the understanding that I am exposing both my person and property to same.

IN CONSIDERATION FOR THE RIGHT FOR ME TO ENTER THE PREMISES, I DO HEREBY RELEASE AND AGREE TO PROTECT, INDEMNIFY AND HOLD HARMLESS, Owners and Operators and each of them, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION OF ANY SORT AND DAMAGES, INCLUDING ATTORNEYS’ FEES, RESULTING FROM ANY ACCIDENT, INCIDENT OR OCCURRENCE ARISING OUT OF, INCIDENTAL TO OR IN ANYWISE RESULTING FROM MY PRESENCE ON THE PREMISES OR USE OF ANY IMPROVEMENTS SITUATED THEREON DURING THE PERIOD OF TIME I AM ON THE PREMISES AND UNTIL I LEAVE THE PREMISES, REGARDLESS OF whether same may result from Owners and Operators NEGLIGENCE OR GROSS NEGLIGENCE.  I hereby further covenant and agree for myself, my heirs, successors and assigns, that I WILL NOT MAKE ANY CLAIM OR INSTITUTE ANY SUIT OR ACTION AT LAW OR IN EQUITY AGAINST OWNERS OR OPERATORS, OR ANY OF THEM, OR THEIR RESPECTIVE HEIRS, SUCCESSORS OR ASSIGNS.  I also further covenant and agree that I SHALL DEFEND AND HOLD OWNERS AND OPERATORS HARMLESS FROM ALL SUCH CLAIMS, SUITS OR ACTIONS BROUGHT NOW OR IN THE FUTURE BY ANY MEMBER OF MY FAMILY WHO MAY HAVE ACCESS TO THE PREMISES BE THEY A MINOR OR OF AGE.
